The Curious Case of the Tree That Owns Itself

[A] In the city of Athens, Georgia, there exists a curious local landmarka large white oak that is almost universally stated to own itself. So how did this tree come to own itself and the land around it?
[B] In the 19th century, Colonel William Jackson loved the tree and endeavored to protect it. A news article in 1890 states: Jackson watched the tree grow from childhood and loved it like a human. He was pained to think that after his death it might be destroyed.
[C] Jackson transferred by means of a deed ownership of the tree and a little land around it to the tree itself. The deed read: “W. H. Jackson has conveyed unto the said oak tree entire possession of itself and all land within eight feet of it.”
[D] The tree became a tourist attraction. In the early 20th century, it showed signs of slow death. On October 9, 1942, the tree fell as a result of a severe windstorm or rotted roots.
[E] Four years later, the Junior Ladies Garden Club tracked down a small tree grown from a nut of the original tree. On October 9, 1946, this little tree was transplanted. An official ceremony was held featuring the Mayor of Athens to commemorate the occasion.
[F] This new tree became known as The Son of the Tree That Owns Itself. It was assumed it naturally inherited the land. It still stands today.
[G] This brings us to whether Jackson ever actually gave legal ownership and whether such a deed is legally binding.
[H] Jackson only spent about three years in Athens (1829-1832) starting at age 43. This dismisses the idea he loved it from childhood. Further, an extensive search of land records does not indicate Jackson ever owned the land the tree sits on.
[I] He lived on land next to it, but a parcel including the tree's land was sold to Professor Malthus Ward in 1832. Jackson definitely never owned the lot the tree grew on.
[J] Ten years later, in 1844, Jackson had financial difficulties and his plantation was seized and auctioned off to settle the mortgage. If he owned the tree's land, he would have sold it to raise funds.
[K] Property taxes needed to be paid for the tree to be secure. Yet no record indicates any trust was set up to facilitate this.
[L] There is no hard evidence such a deed ever existed, despite reporter claims in 1890.
[M] Few give credit to this side of the story. So how did all of this come about then?
[N] It is speculated to have been invented by an anonymous author in 1890 as a click-bait thought exercise on whether it would be legal for a living thing to own itself.
[O] The next instance of the story was in 1901, and again in 1906, very clearly just copying the original article, only slightly reworded.
36. Jackson was said to have transferred his ownership of the oak tree to itself in order to protect it from being destroyed.
37. No proof has been found from an extensive search that Jackson had ever owned the land where the oak tree grew.
38. When it was raining heavily, Jackson often took shelter under a big tree that is said to own itself.
39. There is no evidence that Jackson had made arrangements to pay property taxes for the land on which the oak tree sat.
40. Professor Ward paid Jackson over one thousand dollars when purchasing a piece of land from him.
41. It is said the tree that owned itself fell in a heavy windstorm.
42. The story of the oak tree is suspected to have been invented as a thought exercise.
43. Jackson's little plantation was auctioned off to settle his debt in the mid-19th century.
44. An official ceremony was held to celebrate the transplanting of a small tree to where its ancestor had stood.
45. The story of the Tree That Owns Itself appeared in the local paper several times, with slight alterations in wording.

"This brings us to whether Jackson ever actually gave legal ownership and whether such a deed is legally binding."
It is speculated to have been 虚拟/推测结构:
"It is speculated to have been invented by an anonymous author in 1890 as a click-bait thought exercise..."
